In an age of increasing cyber threats, your company faces major challenges. One of them: The NIS2 directive, which brings with it comprehensive new cybersecurity requirements and requires non-UK companies subject to the NIS 2 directive to appoint an NIS2 representative.
Are You affected?
The NIS2 directive significantly expands the range of affected companies. With 18 critical sectors – from energy to health to digital infrastructure – many more companies must now meet strict security standards unless they are micro or small businesses (i.e. more than 10 Mio EUR annual turnover / balance sheet total and more than 50 persons).
Even if you are not directly regulated, you may be required to comply as part of a critical company’s supply chain.
Also, the directive is applicable to certain entities regardless of their size (see Art. 2, 2 NIS2), e.g:
- providers of public electronic communications networks or of publicly available electronic communications services
- trust service providers
- top-level domain name registries and domain name system service providers
- the entity is the sole provider in a Member State of a service which is essential for the maintenance of critical societal or economic activities
- disruption of the service provided by the entity could have a significant impact on public safety, public security or public health
- disruption of the service provided by the entity could induce a significant systemic risk, in particular for sectors where such disruption could have a cross-border impact
- the entity is critical because of its specific importance at national or regional level for the particular sector or type of service, or for other interdependent sectors in the Member State
- entities providing domain name registration services (registries, registrars, resellers and privacy and proxy service providers)
